1. About These Terms

These Terms of Use ("Terms") apply to newwave.realestate (the "Site"). The Site is run by New Wave Real Estate ("New Wave," "we," "us," or "our"), a team at Real Broker, LLC. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

2. Who We Are

Our team is led by S Braden Breinholt ("Brady Breinholt"), Associate Broker, Utah license # 6337293-AB00, affiliated with Real Broker, LLC. Our team represents clients in Utah. Outside Utah, we refer clients to licensed local agents.

3. Information Only, Not Advice

The Site gives general information about buying, selling, land, and our services. It is not legal, tax, financial, lending, or investment advice. Please talk with a qualified professional about your own situation before you make a decision.

Using the Site, filling out our form, or sending us a message does not by itself create an agency or client relationship. A client relationship starts only when you sign a written agency agreement with Real Broker, LLC.

4. Listings and Property Information

Property details, prices, and status on the Site come from sources we believe are reliable, such as the multiple listing service (MLS), but we do not guarantee them. Listings can sell, change price, or come off the market at any time. Where a page shows an as-of date, that is the date its information was last checked. Please confirm all details, including size, zoning, utilities, and boundaries, on your own before relying on them.

Some listings shown are co-listed with, or listed by, other agents or brokerages. We say so on those listings.

5. Other Companies

Rise Development Group and Clear Path Lending are separate companies. They are not part of or approved by Real Broker, LLC. Brady Breinholt has an ownership interest in each. You are never required to use any company we mention. Brady Breinholt is a real estate agent. He does not take loan applications or arrange loans.

6. Your Use of the Site

You agree not to:

• Use the Site for anything unlawful or misleading
• Send false information through our forms
• Copy, scrape, or republish Site content or listing data in bulk
• Try to disrupt, overload, or get unauthorized access to the Site or its systems

7. Text Messages and Your Information

Text messages are optional and need your consent. Consent is not a condition of purchase. Reply STOP to opt out or HELP for help. Message and data rates may apply. How we collect, use, and protect your information is explained in our Privacy Policy.

8. Content Ownership

The text, design, and logos on the Site belong to New Wave Real Estate or are used with permission. Some photos are used under Creative Commons licenses and are credited where they appear. Listing data belongs to its owners and is shown under MLS rules. You may share links to the Site and view or print pages for your own personal use.

9. Links to Other Sites

The Site may link to other websites, such as the MLS, our brokerage, maps, or social media. We do not control those sites and are not responsible for their content or practices.

10. No Warranty

The Site is provided "as is" and "as available." To the extent the law allows, we make no promises that the Site will be error-free, always available, or free of harmful code.

11. Limit of Liability

To the extent the law allows, New Wave Real Estate, Brady Breinholt, and Real Broker, LLC are not liable for any indirect or consequential loss that comes from using the Site or relying on its information. Nothing in these Terms limits any duty we owe a client under a signed agreement or under Utah law.

12. Governing Law

These Terms are governed by the laws of the State of Utah.

13. Equal Housing Opportunity

We follow the federal Fair Housing Act and Utah fair housing law. We do not discriminate in any real estate service.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we’ll post the new version on this page and change the "Last Updated" date at the top. Your continued use of the Site after changes are posted means you accept the updated Terms.
