1. Who We Are

New Wave Real Estate ("New Wave," "we," "us," or "our") is the real estate business of S Braden Breinholt ("Brady Breinholt"), Associate Broker, Utah license # 6337293-AB00.

Brady is affiliated with Real Broker, LLC, 6975 Union Park Ave, Suite 600, Cottonwood Heights, UT 84047.

This Privacy Policy explains what information we collect through newwave.realestate (the "Site"), how we use it, who we share it with, and the choices you have. By using the Site, you agree to the practices described here.

2. Information We Collect

Information you give us. When you use our "Talk to Brady" contact form, we collect:

• First name
• Email address
• Phone number
• Whether you’re interested in buying, selling, or both
• Any optional message you choose to include
• Your choices on the optional text-message (SMS) consent checkboxes

We may also collect information you share when you email, call, or text us directly.

Information collected automatically. Like most websites, when you visit the Site, our hosting platform may automatically collect basic technical information, such as:

• IP address and general location (for example, city or state)
• Browser type and device type
• Pages viewed, time spent on the Site, and how you arrived (for example, from a search engine or link)

3. How We Use Your Information

We use the information we collect to:

• Respond to your questions and requests
• Help you buy or sell a home, including scheduling calls, showings, or consultations
• Send you text messages you’ve agreed to receive (see Section 5)
• Send emails related to your inquiry and, where permitted, real estate updates you may find useful (you can opt out at any time)
• Keep records of our communications in our customer relationship management (CRM) system
• Meet brokerage supervision, recordkeeping, and legal requirements
• Operate, maintain, secure, and improve the Site
• Protect against fraud, spam, or misuse of the Site

4. How We Share Your Information

We do not sell your personal information.

We share information only as described below:

• Service providers. We use trusted companies to run our business, such as our website and CRM platform, GoHighLevel (LeadConnector), plus providers for email and text messaging. These providers handle information on our behalf and only as needed to provide their services.
• Our brokerage. As a licensed agent, Brady works under Real Broker, LLC. Information may be shared with Real Broker for supervision, compliance, transaction management, and recordkeeping, as required for licensed real estate activity.
• People involved in your transaction. If you work with us to buy or sell a property, we may share information as needed to complete that transaction, such as with lenders, title and escrow companies, inspectors, appraisers, other agents, or the multiple listing service (MLS). We’ll do this only as reasonably needed for your transaction or with your direction.
• Legal reasons. We may share information if required by law, regulation, subpoena, or court order, or to protect the rights, property, or safety of you, us, or others.
• Business changes. If our business is reorganized, transferred, or combined with another business, information may be transferred as part of that change, subject to this Privacy Policy.

Our text-messaging commitments in Section 5 apply in all cases above.

5. Text Messaging (SMS) Program

Our contact form offers two optional and separate checkboxes for text messages:

1. Non-marketing texts about your inquiry, such as replies to your questions, appointment scheduling, and follow-ups about your request.
2. Marketing texts, such as new listings, market updates, or other real estate offers and news.

You may choose one, both, or neither. Checking a box is not required to submit the form or to work with us.

Consent is not a condition of purchase. You do not have to agree to receive text messages as a condition of buying or selling any property or using any of our services.

Message frequency: Message frequency varies.

Rates: Message and data rates may apply, based on your mobile carrier plan.

Opt out: Reply STOP at any time to stop receiving text messages. After you reply STOP, we will send one final message confirming that you’ve been unsubscribed. You can also opt out by contacting us using the information in Section 15.

Help: Reply HELP for help, or contact us at [email protected] or 435-669-0492.

Carriers: Mobile carriers are not liable for delayed or undelivered messages.

Privacy of mobile information: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties.

The service providers that help us send texts (such as our messaging platform) process this information only to deliver our messages and do not use it for their own marketing.

6. Cookies and Analytics

The Site may use cookies, pixels, and similar technologies, including those provided by our website hosting platform, to:

• Make the Site work properly (for example, keeping forms functional)
• Remember your preferences
• Understand how visitors use the Site so we can improve it

The Site uses Google Analytics 4 (measurement ID G-8L9C7FEKQX), plus GoHighLevel forms and cookies.

Your choices: Most browsers let you block or delete cookies through their settings. If you block cookies, some parts of the Site may not work as intended.

The Site does not currently respond to "Do Not Track" browser signals.

7. How Long We Keep Information

We keep personal information for as long as needed for the purposes described in this policy, including to respond to you, provide services, and meet legal, licensing, tax, and brokerage recordkeeping requirements. Real estate transaction records may need to be kept for several years under applicable law and brokerage policy. Information is kept as long as needed for the client relationship or as the law requires.

When information is no longer needed, we delete it or take reasonable steps to de-identify it.

8. How We Protect Information

We use reasonable administrative, technical, and physical safeguards to protect your information, and we rely on reputable service providers to host our Site and data. However, no website, internet transmission, or storage system is completely secure, and we cannot guarantee absolute security.

Please don’t send sensitive information (such as Social Security numbers or bank account details) through the Site’s contact form.

9. Your Choices

• Text messages: Reply STOP to any text to opt out (see Section 5).
• Emails: Use the "unsubscribe" link in any marketing email, or contact us.
• Cookies: Adjust your browser settings (see Section 6).
• Access, update, or delete: Contact us to ask to see, correct, or delete the personal information we hold about you. We’ll respond as required by applicable law. Some information may need to be kept for legal or brokerage recordkeeping purposes.

Even if you opt out of marketing messages, we may still contact you about an active inquiry or transaction you’ve asked us to help with, unless you tell us otherwise.

10. Utah Residents

Utah has a consumer privacy law, the Utah Consumer Privacy Act (UCPA). The UCPA applies to businesses that meet certain size and data-volume thresholds set by the law. Where the UCPA or another privacy law applies to us, Utah residents may have rights such as the right to confirm whether we process their personal data, to access it, to delete personal data they provided to us, to get a copy in a portable format, and to opt out of the sale of personal data or its use for targeted advertising.

Whether or not a specific law applies, we’re happy to help with privacy requests. To make a request, contact us using the information in Section 15. We may need to verify your identity before responding.

As noted above, we do not sell personal information.

11. Children’s Privacy

The Site is intended for adults and is not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has given us personal information, please contact us and we will delete it.

12. Third-Party Links and Listings

The Site may include links to other websites, such as property listing sites, the MLS, lenders, our brokerage, maps, or social media. We are not responsible for the privacy practices or content of those sites. Please review their privacy policies before sharing information with them.

13. Visitors Outside the United States

The Site is intended for people in the United States, mainly Utah. If you visit from outside the U.S., your information will be processed and stored in the United States, where privacy laws may differ from those in your country.

14. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we’ll post the updated version on this page and change the "Last Updated" date at the top. If we make significant changes, we may also provide additional notice. Your continued use of the Site after changes are posted means you accept the updated policy.
